Legal Terms and Conditions Subscription

PREAMBLE

Please read these General Subscription Terms and Conditions (hereinafter “GSC”) carefully, as they apply to any vehicle subscription contract you enter into either through our Platform or through any of our agents. To purchase any of our vehicles through a Subscription Agreement, it is essential that you confirm you have read and accepted these General Terms and Conditions (GTC) and the rest of the privacy policy by checking the box confirming your reading and acceptance of the Legal Notice, the Website Terms of Use, and the GTC, which will be available to you before confirming any purchase. These GTC aim to regulate the Subscription Agreements entered into between a subscriber (hereinafter the Client) and AUTOMOCIO BADALONA CRC3, SL (hereinafter Bookcar), made through the Platform accessed via the website www.bookcar.es , through the Bookcar App, or in person through Bookcar Agents. The Subscription Offer for the Vehicle published on the Platform, in the App, as well as the offer made to the Client at the point of sale, should be considered as special conditions that supplement these GTC. The information included in these GTC is supplemented by the legal information included in our Legal Notice and in our Website Terms of Use at www.bookcar.es .

CLAUSE 1. DEFINITIONS

“Subscription” refers to a flexible, monthly-paid mobility service whereby a vehicle is rented by paying a fee that includes the use of the rented vehicle, its maintenance service, as well as the corresponding comprehensive insurance with deductible, all for a specified period.

“ Lessee ” means any natural or legal person, consumer, professional or non-professional, who subscribes to the Vehicle subscription contract described in the Contract in accordance with these General Terms and Conditions.

“ General Subscription Terms ” or “ GST ” refers to this agreement between Bookcar and the Customer. These terms will govern the term of the subscription agreement for the aforementioned Vehicle. The GST will be supplemented by the corresponding Vehicle Subscription Offer and, where applicable, by the Vehicle Reservation, which shall be considered as specific terms and conditions that complete the GST.

“ Authorized Driver ” designates any driver listed in the subscription contract who meets the necessary conditions for driving the subscribed vehicle.

“ Contract ” refers to the set of all terms and conditions that regulate and govern the Subscription of a Vehicle. The Contract shall be understood to consist of the following elements:

• These General Terms and Conditions;
• The Offer;
• Any specific conditions agreed between Bookcar and the Renter

“ Account ” designates each Client’s personal interface on the Platform, which can be accessed after providing identification and password data.

“ Offer ” refers to a subscription proposal made by Bookcar through the Platform. The Offer includes the vehicle, the pick-up and drop-off location, the subscription dates and, where applicable, times, mileage, prices, and any additional options chosen by the Renter. All Offers are subject to these Terms and Conditions.

“ Party(ies) ” refers individually or collectively to Bookcar and the Lessee.

“ Platform ” refers to the platform that can be accessed at www.bookcar.es/coches-por-suscripcion/ through the corresponding mobile application or in the computer solutions available at points of sale and owned by Bookcar.

“ Permanence ” is the minimum mandatory term of the Subscription contract for the Tenant.

“ Payment Service Provider ” or “ PSP ” refers to the third party responsible for managing the payment gateway for the correct payment of the Reservation. Specifically, the third-party provider of these services will be Stripe Payments Europe, Limited, VAT Number IE 32064488LH.

“ User ” refers to any natural or legal person who accesses and/or browses the website.

“ Vehicle ” refers to the vehicle whose Subscription conditions are subject to these General Terms and Conditions. The Vehicle is the one described in the Offer. The vehicle may be new, used, “Km 0” or nearly new.

“ New vehicle ” will be considered to be one that is not registered.

“ Zero Kilometer Vehicle ” will be considered to be that vehicle registered from the dealership with a reduced number of kilometers but which has never been sold or leased.

A ” used vehicle ” is defined as a registered vehicle that has had an owner, lessee, or user for more than 12 months. These vehicles may come from Drivim Group’s own rental car fleets, from private individuals, or from others who have sold the vehicle to Drivim. These vehicles will have been inspected at official Drivim workshops before being made available to the lessee.

A ” pre-owned vehicle ” is defined as a registered vehicle that has already had an owner, lessee, or user for a maximum of 12 months. These vehicles may come from Drivim Group’s own rental car fleets, from private individuals, or from others who have sold the vehicle to Drivim. These vehicles will have been inspected at official Drivim workshops before being made available to the lessee.

CLAUSE 2. CONTRACTUAL DOCUMENTS

Vehicle Subscription is governed by the Contract, which consists of the following documents:

The present CGS.
The Offer.
The reservation and the specific conditions that may be agreed upon.

CLAUSE 3. OBJECT OF THE CONTRACT

Las presentes CGS tienen por objeto definir las condiciones en las que el Arrendatario suscribe un Vehículo a Bookcar. Se completan con la Oferta, la Reserva hecha por el Cliente y las Condiciones particulares, en su caso.

CLAUSE 4. CONTRACTING PROCESS AND CONDITIONS

The Subscription Contract may be for new vehicles, “Km 0”, semi-new vehicles and used vehicles.

The Subscription Agreement may be entered into on your own behalf or on behalf of a third party. If entered into on behalf of a third party, the person entering into the agreement must have the necessary authorization or power of attorney to enter into the Subscription on behalf of that third party. If the Lessee is a legal entity, the individual making the reservation must provide proof of representation and sufficient power of attorney to enter into the subscription on behalf of that legal entity.

In any case, the Tenant will be:

The person who makes the vehicle reservation and the person who signs the contract.
The holder of the requested documents and holder of the bank card used for online payment.
Registration process

To begin the online registration process, the user must register on the Platform by entering their personal information and all other data required by the system, including bank card details from which the corresponding fees will be charged. Alternatively, users may choose to provide their bank details for direct debit payments from their current account, in accordance with SEPA regulations.

Once registered, the User can select any of the offers published on the Bookcar Platform. The Offer will detail all the vehicle’s features, as well as installment payment options, etc.

The User must select the Subscription features, such as the term, whether they contribute an initial fee as an entry, etc.

Users wishing to subscribe to a vehicle may proceed in one of the following ways:

A. Make the reservation on the bookcar.es/coches-por-suscripcion platform or on the corresponding mobile application:

Vehicle Search:
The User will select the vehicle they wish to subscribe to from the list of available Vehicles.
Please indicate the collection location for the chosen vehicle.
2. Next, the User must:

Please provide the information required by Bookcar for the management of the Subscription.
Examine the vehicle’s features carefully and, if applicable, choose any additional options and/or equipment you desire.
Verify all the information contained in the Offer.
Certify and accept compliance with all conditions stipulated by Bookcar.
Validate the reservation by clicking on the tab provided for this purpose.

Once the Reservation is validated, Bookcar, through its Platform, will send the Renter a Reservation confirmation for the vehicle by email to the address indicated in the registration process.

Once the registration process is complete, the Tenant must pass the validation process before finalizing the Subscription Agreement. To complete the registration process, the Tenant must:

Include the required data on the Platform;
Upload to the Platform the documents required by the system and detailed in clause 5 of this contract.

The Lessee will have the option to pay an initial deposit or not, which will affect the Subscription fee. If an initial deposit is paid, no penalty will be applied in case of early cancellation.

Once registration is complete and all required documentation has been uploaded to the Platform, the subscription contract will be subject to validation by Bookcar.

Validation Process

The validation process will be considered complete when Bookcar, after verifying that the registration process has been completed correctly and all required documentation has been provided, confirms to the Renter that the transaction has been approved. In this regard, Bookcar reserves the right to request additional documentation from the User.

Bookcar reserves the right to analyze the risk of the transaction. For this purpose, it will use the “Nemuru Risk” tool, which will analyze the User’s credit score and provide the necessary information to guarantee Bookcar the viability of the transaction based on the Subscription in question, the amount of the installment, the vehicle model, etc. Nemuru Digital SL, owner of the tool, will act as the data processor and will sign the corresponding data processing and confidentiality agreement.

This Validation process will also apply to any vehicle changes that a Renter may make, and further documentation may be requested if Bookcar deems it appropriate.

Bookcar reserves the right not to approve a Subscription contract if there are defects in the documentation or if the User does not pass the Registration Process or the Validation Process if they fail to meet any of the requirements mentioned above.

Once Bookcar has validated the User, the corresponding vehicle subscription contract will be signed, with Bookcar as the owner and the user as the Lessee.

Mileage

The Subscription Agreement will include the maximum mileage for the vehicle during the subscription period. The vehicle’s mileage will be capped at 800 kilometers per month or 10,000 kilometers per year. If the lessee has exceeded the contracted mileage by the time the vehicle is delivered, an additional charge of €0.20/km will apply.

Accessories

The Renter may add additional accessories to the rented vehicle. If these require official approval, Bookcar will handle all the necessary procedures. The costs of the accessories and the approval process will be the sole responsibility of the Renter, who may pay them in a single payment or by including them proportionally in the monthly rent.

Contract modification

The Lessee shall have the right to request the following modifications to the Subscription Agreement:

Modification of the period of stay

The Tenant may request to modify the rental period to extend the contracted service. If the Tenant has already paid an initial deposit, they will have to pay the difference between the initial deposit and the new, lower rate. If the Tenant wishes to reduce the rental period, they will have to pay, in a single payment, the difference between the initially contracted rate and the rate corresponding to the new, lower rental period. This difference will be calculated based on the installments already paid, and the remaining installments will be adjusted to reflect the reduced rate. In this case, if the customer has already paid an initial deposit, it will not be refunded, and neither the installments already paid nor the remaining installments will be adjusted.

Vehicle modification

The Renter may request to change the rented vehicle. To do so, they must notify Bookcar one month in advance if it is a new vehicle, or 15 days in advance for any other type of vehicle. If only the vehicle is changed and not the contract term, the monthly payments will be adjusted accordingly. If an initial payment has been made, and in addition to changing the vehicle the contract term is extended, the Renter will have to pay the difference between the initial payment and the new requested rate. If the customer wishes to shorten the contract term, they will have to pay the difference between the initial payment and the corresponding payment for the new contracted term.

In the event of a vehicle change, the returned vehicle will be inspected at the time of the change, following the procedure established at the end of the contract, and the new vehicle will be delivered. The installments will be adjusted according to the contracted rate for the relevant vehicle.

Mileage Modification

During the term of the contract, the Lessee may request a modification to the initially contracted mileage allowance. This will affect the calculation of the subscription fee, which will be adjusted proportionally to the requested increase. Any mileage exceeding the agreed-upon mileage will be applied to the next corresponding fee. If a decrease in the contracted mileage allowance is requested, the subscription fee will not be modified.

The mileage can be changed from 800km to 1,200km or 1,600km or 2,000km or 2,500km, with the corresponding variation in fee as stated in the subscription offer.

Any modification to the Subscription contract must be requested from Bookcar via the address info@bookcar.es or by phone 931 159 698 and will be studied and resolved in each case individually.

Vehicle maintenance and repairs

Maintenance, breakdown repairs, and bodywork repairs of the contracted vehicle can only be carried out at the Drivim Group facilities located at the following addresses:

and at any workshops that the Drivim Group has available at any given time, or at workshops approved by Drivim or Bookcar with which it has collaboration agreements. The Renter can check workshop availability and addresses and can book an appointment through the Drivim website at the following link: https://www.bookcar.es/cita-previa . Once on this link, you must indicate whether you want a workshop appointment for a motorcycle or car and identify yourself with the required information.

Vehicle damage and breakdowns

The Renter will always be responsible for any damage caused to the rented vehicle, if they are at fault for the damage, as well as for any breakdowns due to misuse of the vehicle.

-Subscription Agreement in force:

Damages: The Renter will be responsible for any bodywork damage caused to the vehicle, when it is their fault, up to the deductible amount. Any amount exceeding the deductible will be covered by the Insurance. This includes damage detected during the inspection carried out on the vehicle upon its return at the end of the rental agreement. The deductible applies independently to each instance of damage to the vehicle.
Breakdowns: While the Rental Agreement is in effect, any accidental breakdowns of the vehicle will be covered by the vehicle warranty. Breakdowns caused by improper, negligent, or reckless use of the vehicle by the Renter, or by an unauthorized driver, will not be covered. In these cases, the Renter will be responsible for the cost of the corresponding repairs.
Maintenance costs due to wear and tear: In long-term contracts, maintenance costs due to wear and tear, such as battery, brakes and others, will be the responsibility of the Lessee.
Interior vehicle damage: Interior vehicle damage is not insured. Therefore, any interior damage discovered upon vehicle delivery that exceeds normal wear and tear and is due to misuse, abnormal use, negligence, or mistreatment of the vehicle’s interior components or materials will be the responsibility of the Renter. Bookcar will provide the Lessor with a repair estimate before proceeding with any repairs.
In addition, certain aspects of the Subscription Agreement may differ depending on the type of vehicle contracted:

1- New Vehicle Subscription

Personalization

The lessee may customize the subscribed vehicle provided the subscription agreement is for a minimum of 11 months. In these cases, the vehicle cannot be changed before the 11 months have elapsed.

Delivery time

It will depend on Bookcar’s stock situation or the vehicle’s production.

Contract termination

The Subscription Agreement for this type of vehicle will terminate upon the expiration of the stipulated term, except as provided in clause 6 of this agreement.

Purchase option

The Renter may consult with Bookcar regarding the availability of exercising a purchase option for the rented vehicle.

Warranty

New vehicles covered by the subscription contract will have the manufacturer’s warranty.

2- Subscription for “Km 0” Vehicles, nearly new vehicles or used vehicles.

Personalization

The Lessee will not be able to customize these types of vehicles as they are already registered vehicles.

Purchase option

The Renter may exercise an option to purchase the vehicle provided the Subscription has been contracted for a period of 9 months or more. The option to purchase the vehicle is always voluntary for the Renter. To exercise the purchase option, the Renter must notify Bookcar of their intention to do so at least one month prior to the contract’s expiration. Once the contract has ended and the purchase option has been exercised, the Renter will become the owner of the vehicle for all purposes. If the Renter has not exercised the purchase option within the specified period, Bookcar reserves the right to put the vehicle up for sale through any means or platforms it deems appropriate so that it may be purchased by a third party. However, the Renter, within the specified period, will have the right of first refusal over any third party.

Contract termination

The Subscription Agreement for this type of vehicle will terminate upon expiration of the stipulated term, except as provided in clause 6 of this agreement. Likewise, the Lessee will have the right to terminate the Subscription Agreement for this type of vehicle at any time.

If the subscription agreement has a term of less than six (6) months, the Renter must notify Bookcar at least 15 days in advance of the desired termination date. In these cases, if the early termination occurs between three (3) and six (6) months, the Renter must pay the difference between what they have paid up to the termination date and what they should have paid for a contract agreed upon from the beginning for that duration. If the early termination occurs between zero (0) and three (3) months, the Renter must pay the difference between what they have paid up to the termination date and what they should have paid for the actual contract period, taking into account the one-month subscription rate.

If the contract has a term of six (6) months or more, the Tenant must give at least one month’s notice of the desired termination date. In these cases, the Tenant will forfeit the right to claim any down payment, either in full or in part, which will be used to offset the difference in the rent paid. If the Tenant has not paid a down payment, the Tenant must pay the difference between what has been paid up to the termination date and what would have been paid for a contract with that initial term.

If the contract is for a new vehicle, the minimum rental period is 11 months. If the lessee requests early termination, they must pay all outstanding installments.

Warranty

Vehicles of these types covered by the subscription contract will have the manufacturer’s warranty or the warranty contracted according to the age and origin of the vehicle.

CLAUSE 5. DOCUMENTATION THAT THE TENANT MUST PROVIDE

Before the effective start of the Subscription, the Renter, through their Account on the Platform or in person, will send Bookcar a copy of the following documents requested in the Offer:

Double-sided copy of a valid ID card or NIE.
Double-sided copy of the driver’s license.
Valid credit or debit card
Any other document requested in the Contract.
These documents provided by the Tenant must be truthful, valid and in force at all times during the term of the Subscription Agreement, so, in case of expiration of any of them, the Tenant must upload the corresponding updated documents to the platform.

The Client undertakes to upload to the Platform all required documents in a legible format as soon as possible and, at the latest upon taking possession of the Vehicle, also undertakes to inform Bookcar without delay of any changes in the validity of said documents.

The Renter is informed that Bookcar may cancel the Reservation, even if the requested documents are incomplete, illegible, untrue, expired, or contravene any applicable regulations at the time scheduled for taking possession of the Vehicle, without this cancellation compromising the payment of the Reservation or any compensatory right.

CLAUSE 6. DURATION OF THE SUBSCRIPTION AGREEMENT

6.1 Stay

The contract term will vary depending on the vehicle type and the subscription period. This will be specified in the contract’s terms and conditions. For subscription contracts for nearly new (Km 0) or used vehicles, the term may be 1, 3, 6, 9, 12, 18, 24, or 36 months. In the event of early termination, the penalties described in clause 4 will apply.

In the case of new vehicle subscription contracts, the term will be eleven (11) months. If the contract is cancelled early, the penalty described in clause 4 of this contract will apply.

6.2 Contract duration

The duration of the Subscription Contract will be set in the contract itself and may not be less than the Commitment Period indicated in the contract itself.

6.3 Renewal

Upon expiration of the Subscription Agreement, it may be automatically renewed for successive monthly periods, unless either party provides at least fifteen (15) days’ notice prior to the expiration date of the corresponding monthly period. Such notice may be given through the Platform or other means of communication stipulated in this Agreement.

In the event of automatic renewal, the monthly fee could be adjusted based on the down payment made by the Tenant at the beginning of the contract so that it corresponds to the fee that would correspond to a contract started without a down payment.

If the Vehicle is not available for the new requested period, the Renter agrees to return the Vehicle at the place, date, and time initially agreed upon, and in accordance with the conditions stipulated in these Terms and Conditions. If other Vehicles are available, the Renter may make another Reservation.

The Renter acknowledges that, in the event of absence of response from Bookcar, this would not imply tacit acceptance of the request submitted by the Renter.

The additional kilometers driven by the Lessee in the Subscription Contract that has expired must be paid for by the Lessee even if the Contract is renewed with the same Vehicle.

If the Renter does not return the Vehicle in the condition, place, or time specified in the Contract and has not agreed to an extension with Bookcar, they must pay compensation for each day of delay, equivalent to the Maximum Daily Rate, which is €50/day + VAT. Bookcar may deduct this compensation from the amount retained from the Renter as a security deposit.

The Renter acknowledges that failure to return the Vehicle as agreed in the Contract may imply Bookcar exercising all actions that may correspond to it under the law to defend its interests and be compensated for the damages caused.

CLAUSE 7. ECONOMIC CONDITIONS OF THE SUBSCRIPTION

7.1 Fee

The vehicle subscription will obligate the Lessee to pay a monthly fee for the duration of the contract.

The subscription fee will vary depending on several factors, including the type of vehicle, the subscription period, and the minimum contract length. The subscription fee will be shown in the offer for each vehicle and will be valid as stated in the online or in-person reservation made at Bookcar.

The monthly payments will be charged to the card the Tenant registered on the Platform via Stripe. You can find detailed Stripe’s privacy policy at the following link: https://stripe.com/es/privacy . Alternatively, payments can be made via direct debit in accordance with SEPA regulations if the customer requested this option during initial registration.

The monthly fee includes the following items:

Vehicle rental
The agreed mileage

-Insurance with the coverages indicated in the Special Clauses, with a deductible, in case of own damage or accident. The deductible amount varies depending on the vehicle model and represents the maximum amount payable by the User in case of theft, accident or damage.

Roadside assistance;
Maintenance and service;
The vehicle tax;
ITV
Replacement car in case of breakdown, subject to the limitations set out in these CGS;
Bookcar customer service from 8am to 1:30pm and from 3:30pm to 7pm; Monday to Friday.
Insurance Company Customer Service: 24/7 days a week.

Under no circumstances will the payment of the Fee include fuel, Adblue and/or any energy sources that are necessary for the operation of the vehicle.

Failure to pay the Fee and/or any other financial obligations arising from the Subscription Agreement will be considered a serious breach of contract.

The Renter’s card will also be charged for any fees incurred during the term of the Contract, regardless of the rental amount, or for any fees incurred after the vehicle inspection once the Contract has ended and the vehicle has been returned to Bookcar. If the Renter has opted to pay by direct debit under SEPA regulations, the charges will be applied to their bank account.

The Renter will be able to access their invoices from their Bookcar Account

7.2 Additional expenses

In the event of a breach by the Renter, Bookcar will deduct an amount from the security deposit. The amount of such compensation is indicated in the schedule of expenses in these Terms and Conditions.

If the amount of these additional expenses exceeds the amount of the deposit, Bookcar may charge the corresponding amount to the Renter’s card.

7.3 Payment terms. Authorization for debiting accrued amounts

The Tenant is hereby informed that payment will be made online by bank card through the payment service provider or, if applicable, by direct debit. The bank card must be in the Tenant’s name, especially if the insurance benefit is contingent upon the use of this card. If the Tenant has opted for payment by direct debit under SEPA regulations, the charges will be applied to their bank account, which must be in the name of the contract holder.

The Renter authorizes Bookcar to charge the selected bank card or bank account for all sums related to the execution of the Contract, including any total expenses that may arise in the event of partial breach of the Terms and Conditions and any deductibles incurred by the Renter in the event of an Accident. The amount of these charges is indicated in the schedule of expenses attached to the Terms and Conditions.

7.4 Guarantee or security deposit

As a guarantee for the fulfillment of its obligations and to ensure the proper execution of the Contract by the Lessee, a security deposit will be charged to the credit card or bank account held by the Lessee at least seventy-two (72) hours before the date of taking possession of the Vehicle and, at the latest, at the time of collection. The deposit will be returned to the Lessee at the end of the subscription contract, except as provided in this clause.

The security deposit amount may vary depending on the vehicle category. The renter must have sufficient funds in their bank account or on their credit card and be able to cover the charges arising from the contract.

Bookcar will, in any case, require the Lessee to pay a deposit of at least 750 euros for the subscription of passenger cars and at least 1,200 euros for the subscription of commercial vehicles, an amount that must be paid at the time of contracting.

If the Tenant’s bank denies the security deposit, the Platform will notify the Tenant by email so they can manage and verify the denial. The Tenant may then make a new security deposit using the same card or bank account, or a different one, which they must also be the legitimate account holder of.

The Reservation will be automatically cancelled if none of the different attempts to collect the security deposit have been successful at least in the twenty-four (24) hours preceding the taking of possession of the Vehicle.

The Tenant acknowledges and accepts that, in any case, the corresponding management fees may be charged to their card or bank account. The amount of these fees is indicated in Annex 1 of the schedule of expenses in these General Terms and Conditions.

The security deposit or bond will cover, up to the amount of which it does not exceed, repairs to the Vehicle and its accessories, penalties, expert appraisal costs, the insurer’s deductible, documentation costs and any other sum in compensation for damages that the Renter may have caused, voluntarily or involuntarily, to the Vehicle, to a third party or to Bookcar.

However, the security deposit does not release the Renter from having to pay any amounts that may exceed the total amount of the security deposit, which may be claimed from the Renter by Bookcar in accordance with the applicable legislation.

CLAUSE 8. DRIVER(S) OF THE SUBSCRIBED VEHICLE

8.1 Lessee

Without prejudice to the requirements indicated in the Vehicle Offer, the validity of the General Terms and Conditions will be subject to the Lessee, if a natural person, or the authorized driver if a legal entity, meeting at least the following conditions:

To hold a valid driving licence in Spain, and to have obtained it more than:
One (1) year for the vehicle categories:

In both cases, these requirements must have been met before the day of taking possession of the Vehicle.

Be over eighteen (18) years old.
Have a valid driving license for the territory in which you intend to use the Vehicle Subscription.
In particular, not having been subject to annulment or suspension of the driving license or being involved in a sanctioning procedure in relation to (i) accidents or damages to third parties for which he/she was responsible, (ii) negligent, reckless or dangerous driving, (iii) driving under the influence of alcohol or other narcotics or (iv) any other infringement of the Traffic Code or the legislation applicable to the effect.
Bookcar reserves the right not to grant the Vehicle Subscription if the Renter or the additional Driver cannot prove in due time and form that the driving license is valid and will be valid during the course of the Subscription.
Have a payment card in your name or in the name of the legal entity you represent in accordance with applicable legislation.
Submit the requested bond or security deposit.
Under no circumstances may a single Renter subscribe to more than one Vehicle at the same time, except if it is a company and has not had any prior issues with Bookcar, or if Bookcar deems it necessary to impose a limitation. Examples of issues include: non-payment, problems returning the vehicle, etc.

8.2 Validity of the driving licence

A driving license issued in accordance with and in compliance with current Spanish legislation will be considered valid.
If the driving licence was issued by the Public Administrations of a country belonging to the European Economic Area (European Union, Iceland, Liechtenstein, Norway), the licence will be considered valid without the need to provide additional documentation.
If the permit was issued in a version not supported by the Platform, its validity cannot be checked from the Platform. In this case, Bookcar’s customer service will contact the Renter to carry out this check within 48 hours of the Booking and will subsequently notify the Renter of the decision regarding the acceptance of the document within a maximum of 48 hours.
If the driving licence was issued by a country outside the European Economic Area, the Renter must verify the validity of the document by sending a photograph of each of the following documents by email to clientes@bookcar.es :
Valid driver’s license.
An official translation of said driving license or a valid international driving permit.
The Client must send these documents, at least, within forty-eight (48) hours before taking possession of the Vehicle.

If the Renter holds a driving licence issued outside the European Economic Area, and has student status, he/she will undertake to present Bookcar with a valid document of stay, no later than the day of vehicle collection.
If the Renter holds a driving licence issued outside the European Economic Area, he or she also undertakes to present to Bookcar, no later than the day of vehicle collection, a document valid for driving within the European Economic Area.
8.3 Additional Driver

The Lessee, whether a legal entity or a natural person, may, when deemed appropriate, request that one or more additional drivers be listed as authorized to drive the subscribed Vehicle.

Up to three additional drivers can be added free of charge.

Additional drivers must also comply with the conditions imposed on the Lessee, regarding the validity of the driving license and the other conditions mentioned in section 8.

Additional drivers accepted in writing by Bookcar through the Platform must present the originals of their driving licenses and the identity documents necessary to carry out the verifications in the previous sections, no later than at the time of taking possession of the Vehicle so that Bookcar can validate them through the Platform.

The Lessee will be personally and directly responsible for any additional drivers who make use of the Vehicle during the Subscription.

8.4 Young Driver

Drivers under 24 years of age, in addition to meeting the conditions set out in this contract, will be subject to an extra charge as detailed in Annex I.

CLAUSE 9. VEHICLE

Renter fully responsible for any damage that the Vehicle may suffer or damage to third parties.

The Lessee and any additional drivers authorized in accordance with Clause 8.3 acknowledge that the insurance taken out will only cover the use of the Vehicle in the countries covered by the Insurance and that driving the Vehicle in a country not on that list is prohibited and excluded from the insurance coverage.

The area of ​​circulation of the Vehicles is limited to the countries of the European Economic Area, including Andorra, Gibraltar, Monaco, Sant Marino, Vatican City and Liechtenstein.

If, during the Subscription contract period, any indicator of an anomaly or malfunction of the Vehicle illuminates on the instrument panel that could directly affect its safety and/or correct driving, or when external signs indicating breakdown or malfunction are detected, the Renter must contact Bookcar as soon as possible and stop the Vehicle.

Bookcar recommends that the Renter and all other Authorized Drivers pay attention to the vehicle’s dimensions and height limits (especially for commercial vehicles). Miscalculating the vehicle’s height limits in relation to road infrastructure, resulting in loss or damage to the vehicle, may lead to the exclusion of some optional insurance coverages.

Even if the Renter has taken out insurance with one or more optional guarantees, the Renter or authorized driver may be liable for direct and indirect damages, costs and legal expenses arising from any use of the vehicle contrary to this clause.

9.3 Vehicle maintenance and repairs.

In the event that the Vehicle requires repair during the Rental Period, the Renter agrees to notify Bookcar immediately. The Renter acknowledges that any repairs carried out without Bookcar’s prior written consent, as well as any resulting damages, will be the sole responsibility of the Renter, unless the Renter can demonstrate that the repair was urgent and essential.

Maintenance, breakdown repairs, and bodywork repairs of the contracted vehicle can only be carried out at the Drivim Group facilities located at the following addresses:

and at any workshops that the Drivim Group may have at any given time or with which it has a collaboration agreement. The Renter can check the availability of the workshops and their addresses and can book an appointment through the Drivim website at the following link https://www.bookcar.es/cita-previa/ or by calling 931 159 698 or via the App to customer service WhatsApp or by email to info@bookcar.es

9.4 Roadside assistance

The roadside assistance conditions for vehicles with a Subscription contract will be described in the vehicle insurance policy that Bookcar will make available to the Renter.

9.5 Vehicle Return

The Renter or, where applicable, any additional drivers authorized in accordance with Clause 8.3, undertake to personally deliver the Vehicle on the date and at the place agreed with Bookcar.

The Lessee agrees to return the Vehicle in good condition, accompanied by all its accessories (especially those relating to safety), on-board documents, instructions and operating manuals, which will be replaced at his expense in case of destruction, loss or theft, in addition to the payment of compensation for management expenses, which will be charged to the card that appears in the contract and whose amount is indicated in the CGS, in the scale of expenses that appears as Annex 1.

Once the Renter has returned the vehicle, it will be inspected by Bookcar in the Renter’s presence at Drivim’s workshops or offices, and any exterior damage will be noted. The Renter will be responsible for any damages attributable to them, up to the limit of the deductible for each incident involving the vehicle.

If the Renter does not carry out the check upon returning the Vehicle (except in the case of force majeure), it will be considered that they accept the check carried out by Bookcar or a person on their behalf.

CLAUSE 10. INSURANCE

The driver of a motor vehicle is responsible, by virtue of the risk created by driving, for damages caused to persons or property as a result of traffic.

However, the vehicle subject to the Subscription contract will be covered by mandatory civil liability insurance in accordance with current regulations.

The Lessee and authorized drivers, subject to compliance with the obligations arising from these General Terms and Conditions, will therefore be protected against the consequences of civil liability incurred for bodily injury or material damage caused to third parties (including passengers of the Vehicle) arising from the driving of the subscribed Vehicle involved, up to the legally established amount.

The subscription fee includes comprehensive insurance taken out by Bookcar. The insurance policy has a deductible of €600 for cars and €750 for commercial vehicles. The deductible will be applied individually to each claim for damage the vehicle may sustain during the term of the subscription agreement.

The Renter will have at their disposal a copy of the insurance policy contracted by Bookcar.

CLAUSE 11. LOSS AND DAMAGE CAUSED TO THE VEHICLE

11.1 Principle of responsibility of the Customer and of the Authorized Drivers

The Lessee and authorized drivers will be liable for loss and damage caused to the vehicle during the Subscription period under the terms provided in these General Terms and Conditions.

For their part, the liability of the Lessee and the Authorized Drivers may be limited in accordance with the conditions listed below.

11.2 Limitation of liability

The application of the Limitation of Liability will be subject to the Client’s compliance with these General Terms and Conditions.

Additionally, the Renter may reduce their liability by taking out optional insurance guarantees, which Bookcar will make available to them.

11.2.1 Limitation of liability in case of theft, accident and fire

In case of theft, accident and fire, the liability of the Lessee or the authorized Driver with respect to material damage suffered by the vehicle and its accessories and equipment, will be limited to the sum indicated in Annex 1 of these CGS or in the vehicle’s insurance policy.

11.2.2 Causes of exclusion for the application of the Limitations of liability

The same damages and losses already excluded in these General Conditions are excluded from these liability limits and, in addition, the cases and causes that are stated in the insurance policy of the contracted vehicle.

Regarding coverage for damage to the insured vehicle and fire:
Damage to the vehicle caused by transported objects.
Vehicle depreciation.
Damage to equipment outside the limits established in Annex 1 of these CGS.
Damage to the vehicle on roads unsuitable for traffic.
Damage caused by negligent use of the vehicle after an accident.
The engine seized.
Damage to the vehicle during maritime or air transport.
Regarding the theft coverage of the insured vehicle:

The negligence of the policyholder, the insured, or those who live with or depend on them.
Theft committed by family members.
Damage to the vehicle’s equipment, or its accessories, outside the limits established in the Annex of these General Terms and Conditions.

CLAUSE 12. OBLIGATIONS IN CASE OF LOSS

12.1 General Obligations

In the event of any incident: accident, theft, attempted theft, fire, collision with a wild animal or any other damage suffered by the vehicle, the Renter or any authorized Driver must take all useful measures to safeguard the interests of Bookcar and, if necessary, the insurance company, namely:

Notify Bookcar immediately or at the latest within twenty-four (24) hours after the occurrence or discovery of any of the aforementioned incidents or damages
Notify the Security Forces if necessary.
Complete the friendly accident statement (the “Statement” ), which must be sent to Bookcar duly completed under penalty of losing the Insurer’s Limitation of Liability and Optional Guarantees, mentioned in Clause 11.2.
The Claims Statement, which must be sent to Bookcar’s Claims Department as soon as possible, should include:

the circumstances, date, place and time of the accident
the name and address of any potential witnesses
If necessary, the registration number of the third party involved, the name and address of its owner, the name of the insurance company and the policy number of the insurer.
The loss or theft of the vehicle does not automatically imply an obligation on the part of Bookcar to provide the Renter with a replacement vehicle.

12.2 Specific obligations in case of accident

In the event of an accident, the Client or authorized Driver must complete the report available in the vehicle, except in cases of force majeure.

If a report has been prepared by the Security Forces, these documents must be attached to the aforementioned Declaration.

The Customer or the authorized Driver is not authorized to close any agreement or transaction on behalf of Bookcar or its Insurance Company.

12.3 Specific obligations in case of theft

In the event of vehicle theft, it must be reported immediately to the competent authorities. The Customer or authorized Driver must provide Bookcar with a copy of the verbal police report as soon as possible, under penalty of losing the benefit of the Limitations of Liability listed in Clause 11.2.

Furthermore, the original vehicle keys must be returned to Bookcar. In the event of theft or loss of the original keys, the Renter or the authorized Driver must immediately report the theft or loss to Bookcar and the relevant authorities. Failure to return the keys will result in the loss of the benefits of the Limitations of Liability and Optional Insurance Coverage listed in Clause 9. Moreover, in the absence of a report of theft or loss of the keys, the renter’s outstanding fees will continue to accrue.

CLAUSE 14. CANCELLATION OF THE RESERVATION

If the Renter contracts with Bookcar as a Consumer, in accordance with the provisions of the General Law for the Defense of Consumers and Users, it is noted that the right of withdrawal will not apply to the supply of vehicle Subscription services with specific execution periods as established in article 103 of the General Law for the Defense of Consumers and Users.For any cancellation of the Contract by the Tenant:Before the date of possession of the Vehicle, Bookcar will not charge the Renter anything and if the Renter has made a reservation, it will be refunded in full (100%) unless Bookcar has incurred any specific costs for the delivery of the vehicle (e.g., transport), in which case the Renter will be charged the corresponding amount. Once the date specified in the Contract for taking possession of the Vehicle has arrived, if the Renter cancels the contract, Bookcar will have the right not to refund the amount of the reservation to the Renter or, if the reservation has not been paid, to charge the Renter the amount corresponding to one installment. In the event of unavailability of the Vehicle specifically reserved by the Renter, Bookcar undertakes to inform the Renter and offer another Vehicle of similar or higher category depending on the availability of Vehicles on the Platform, for the dates and duration of the Contract.

CLAUSE 15. TENANT’S LIABILITY IN CASE OF BREACH

The Lessee agrees to be held responsible, without limitation, for all violations or infringements of any legislative provision committed during the term of the Contract and the Subscription, specifically will be responsible for any violations of the Traffic Code committed with the Vehicle during the duration of the Contract.The Renter shall indemnify Bookcar against any penalties, fines, fees, surcharges, and in general costs or charges, including attorney’s fees if applicable, of any kind imposed or borne by the Renter for any infringements ultimately committed by the Renter.The Renter agrees to report all violations of legal or regulatory provisions that may have occurred while the Vehicle was in their possession during the term of the Agreement. The Renter will be informed that Bookcar, or a third party appointed by Bookcar, will take all necessary steps to ensure that the Renter, who had custody of the Vehicle at the time of the violation, assumes responsibility for their actions.In particular, if it is not possible to identify the specific Driver who had the Vehicle at that time, the Lessee will in any case be responsible for the payment of the fine or penalty committed during the term of the Subscription contract.For traffic violations committed by the Renter with the Vehicle during the term of the Contract, Bookcar will systematically charge an amount, concerning the expense for managing said violation, to the Renter’s card, the amount of which will be indicated in the scale of expenses Annex 1 to the CGS.

CLAUSE 16. FLEET CONTROL

The vehicle covered by the Subscription Agreement will be equipped with a geolocation system that will allow Bookcar to locate the vehicle in case of emergency, theft, abandonment, serious breach of contract by the Renter, and other situations justified for security reasons. This system will under no circumstances allow Bookcar to geolocate the vehicle continuously or in situations other than those mentioned above.

The vehicle will also be equipped with a system that allows for monitoring the fuel level and ignition. This system will only be used for record-keeping purposes at the end of the contract or in cases justified by emergencies, theft, abandonment of the vehicle, or serious breach of the Subscription Agreement by the Le

CLAUSE 17. PERSONAL DATA

The personal data of the Renter and any authorized Drivers will be collected and processed by Bookcar, as the data controller, for the purpose of managing, executing, and ultimately providing the services covered by the Subscription Agreement. Therefore, the legal basis for processing the personal data of the Renter or any authorized Driver will be the performance of the aforementioned Subscription Agreement.

If Bookcar is not provided with the necessary personal data, Bookcar may not subscribe the Renter.

Furthermore, also for the better development and execution of the Subscription Contract, in those Vehicles equipped with a telematics unit, the following will occur: (i) the automatic transmission of data relating to kilometers per route and fuel level in order to verify the conditions of the vehicle at the time of delivery and return and (ii) the transmission of an impact detection warning so that action can be taken more effectively in verifying the condition of the Vehicle upon its return.

Your personal data may be shared with third-party entities necessary to verify your identity or the validity of your driver’s license. However, when necessary for the management of traffic violations, or any other applicable legislation that may have been infringed during the Subscription Agreement, your personal data may be shared with the third-party entities necessary for managing these violations, with law enforcement agencies, or with the courts.

Finally, your personal data may be processed by certain Bookcar service providers involved in the management or execution of the Subscription Agreement, such as call center and customer service providers or providers managing the Platform through which you carry out the contracting and management of the Vehicle Subscription.

The Renter and any authorized Drivers, as interested parties, may exercise their rights of access, rectification, erasure, limitation of processing, portability and, if applicable, also the right to object to the processing of their personal data by sending their request, duly identified, to privacidad@bookcar.es .

In certain circumstances, Bookcar, or its agent, may transfer the Renter’s or Authorized Driver’s personal data to recipients located in countries outside the European Economic Area (EEA) for the provision of services. The transferred data will be protected using the data transfer mechanisms established by current data protection regulations. The retention period for the collected personal data will be determined based on the following criteria:

The data will be stored for the time necessary for the management and execution of the Subscription Contract, in accordance with the regulations, while Bookcar maintains a business relationship with the Renter.
Next, personal data will be blocked for the applicable statute of limitations period to comply with legal or regulatory obligations to which Bookcar may be subject, as well as to address any potential liabilities arising from its processing.
Finally, the data will be anonymized or deleted.
You have the right to file a complaint with the Spanish Data Protection Agency through its website www.aepd.es

CLAUSE 18. PARTIAL NULLITY

Should any clause of these General Terms and Conditions be declared invalid, it shall be removed or replaced. In any case, such a declaration of invalidity shall not affect the validity of the remaining provisions of these General Terms and Conditions.

CLAUSE 19. APPLICABLE LAW

The Vehicle Subscription and these General Terms and Conditions shall be governed by and construed in accordance with Spanish law and any conflict or dispute arising between the Renter and Bookcar shall be dealt with by the competent courts and tribunals in accordance with applicable legislation.

EXPENSES (maximum recommended prices including VAT):

If the vehicle is returned in an abnormally dirty condition, the following cleaning charges will apply:
Level 1 wash (interior wash) = €40
Level 2 wash (deep interior and exterior wash) = €90
Additional driver = Included in the contract, with a limit of 3. €20/month will be billed for each extra driver when the number of drivers exceeds 3.
Young driver: charge of €30/month + VAT for drivers aged between 18 and 20 years (both inclusive), and €20/month + VAT for drivers aged between 21 and 24 years (both inclusive)
